A recall of electric log splitters was announced by the US Consumer Product Safety Commission. The splitters were sold at Lowe’s outlets and allegedly do not have adequate safety labels warning users of cuts and potential amputation if they use the hydraulic arm handle during operation. The 5-ton log splitter was made in China and sold across the country between January 2008 and March 2011 for about $300 each. The hydraulic arm poses an hazard to anyone who puts their hands on its handle while the machine is running. As of now, two reports of injuries have surfaced. Those include a fingertip amputation and finger laceration. Both individuals who were injured put their hands on the machine’s handle while it was operating.

According to news reports, the recall affects approximately 20,000 log splitters. As an auto accident lawyer in Lebanon, I hope that nobody is adversely affected by this product. • Chevrolet Malibu Recalled for Trunk Dangers

Posted Jul 12th, 2011 By in Personal Injury, Personal Injury Lawyer, Product Liability With | No Comments

2000-2001 model Chevrolet Malibu vehicles are being recalled by General Motors due to the fear that children may become trapped in their trunks. Vehicles are being retrofitted to include internal truck releases free of charge. A tragic accident happened when two boys from Indiana were discovered locked inside a hot car truck. The incident was “eerily similar” to a case two years ago when a five-year-old and four-year-old became trapped inside a 2000 Malibu. KidsAndCars.org requested that GM retrofit all their cars to include the trunk releases. Beginning in 2002, vehicles began including a glow-in-the-dark release handle inside the truck, however many vehicles manufactured before that year are still considered hazardous.

According to news reports, kits are available from KidsAndCars called “Quick Out” for $9.99. As an auto accident lawyer in Waynesboro, I hope that nobody is adversely affected by this product. Macy’s is being charged a civil penalty for failing to report recalled children’s clothing. They were recalled because drawstrings on the clothes posed a strangulation and entanglement hazard to consumers. Allegations were filed against Macy’s because they failed to report the incident to the Consumer Product Safety Commission. Macy’s and other stores owned by the company sold the recalled sweatshirts, sweaters, and jackets. These garments included Macy’s Epic Threats hooded sweatshirts, NTD Apparel Hello Kitty hooded sweatshirts, and Quicksilver Hide & Seek hooded sweatshirts. Macy’s denied the allegations by the CPSC.

According to news reports, CPSC issued guidelines in 1996 to prevent children from getting entangled in drawstrings, because they pose a serious safety hazard. Three teenagers, including two half-brothers, succumbed to their injuries after a high-speed collision involving a stolen pickup truck. The crash happened in northwestern Pennsylvania when a 16-year-old was driving his car and crashed just outside Oil City at 3:35am, around 70 miles north of Pittsburgh. A 17-year-old and another 16-year-old were both killed in the crash. The truck was traveling at an “extremely high rate of speed” when it collided through a utility pole and slammed into a pine tree. The truck came to a rest on its roof, then burst into flames.

  • Lawyers Use Social Networking as Evidence

Posted Jul 11th, 2011 By in Personal Injury, Personal Injury Lawyer With | No Comments

Social networking sites such as Facebook, MySpace, or Twitter are being used more and more often in lawsuits. Lawyers are sifting through these social networking sites in order to come up with useful information in a court case. Despite attempts to consider this information protected, courts are allowing use of social media websites as unprivileged information. For example, both parties of a recent case in Pennsylvania asked for a review of the plaintiff’s profiles on social networking sites in order to conduct an investigation. In a divorce settlement, the wife claimed car accident injuries left her unable to work, but her ex-husband countered with information detailing her belly dancing years after surgery.

According to news reports, photographs or status updates could be possibly used as court evidence. As a Washington DC car accident attorney, I look forward to hearing more how social media can connect with court cases.
