Court Rules Traumatic Events are not Normal Working Conditions
A court ruling recently granted workers’ compensation benefits for a man who suffered psychological trauma that the court deemed outside of his normal working conditions. The man referenced in the case was a store manager at a liquor store where was robbed at gunpoint. This was the second ruling, as an appeal was filed. The first ruling was denied after opposition from the Pennsylvania Liquor Control Board.
The state Supreme Court ordered the Commonwealth to have another look at the case. The Commonwealth court referenced another court decision whereby a state trooper killed a pedestrian who ran in front of his police car in Cumberland County. In that ruling the Supreme Court found that he experience has traumatized the officer in a way that could not be considered a normal working condition.
