Consolidation of Bair Hugger Cases Under Review
Federal Bair Hugger Warming Blanket Cases: Consolidation Or Not?
This week, one of the plaintiffs from the 14 federal Bair Hugger Warming Blanket lawsuits pending around the country moved for consolidation of the cases into a U.S. District Court in Minnesota. The consolidation sought Multidistrict Litigation (MDL) status for the group of cases so that they could be heard together in a single court. The location was chosen because the manufacturer of the Bair Hugger Warming Blanket, 3M and its subsidiary Arizant, are based in Minnesota.
The 14 federal court cases which may be consolidated allege that 3M sold a defective product and failed to adequately warn about the dangers inherent in using the warming blankets during hip and knee replacement surgeries. The lawsuits ask for financial damages associated with surgical site infections (SSI) which the plaintiffs allege were caused by a defect in the forced-air blankets, and the medical costs which they incurred receiving additional treatments and surgeries for the infections.
Bair Hugger Warming Blanket Lawsuits
Although the consolidation sought in federal court does not apply to the many other cases filed against 3M over the Bair Hugger Warming Blankets in state court, each of these product liability lawsuits share a common set of complaints. Primarily, the lawsuits arise out of a defect in the Bair Hugger Warming Blankets where warm air escapes from the blanket during surgery, thus forcing bacteria in the cooler air along the floor of operating rooms upward, where it has entered the incisions created during surgery. Dangerous infections have resulted.
The problem with the Bair Hugger Warming Blankets have gotten so extensive that the inventor of the product himself, Dr. Scott D. Augustine, has warned against its use in knee and hip replacement surgeries in a letter he wrote to the New York Times. Our Harrisburg PA products liability attorneys at Handler, Henning & Rosenberg have written our own information page about the problems arising with the use of Bair Hugger Warming Blankets, which you can read on our website.
