Consolidation of Bair Hugger Cases Under Review

This week, one of the plaintiffs from the 14 federal Bair Hugger Warming Blanket lawsuits pending around the country moved for consolidation of the cases into a U.S. District Court in Minnesota. The consolidation sought Multidistrict Litigation (MDL) status for the group of cases so that they could be heard together in a single court. The 14 federal court cases which may be consolidated allege that 3M sold a defective product and failed to adequately warn about the dangers inherent in using the warming blankets during hip and knee replacement surgeries. The lawsuits ask for financial damages associated with surgical site infections (SSI) which the plaintiffs allege were caused by a defect in the forced-air blankets, and the medical costs which they incurred receiving additional treatments and surgeries for the infections.

Although the consolidation sought in federal court does not apply to the many other cases filed against 3M over the Bair Hugger Warming Blankets in state court, each of these product liability lawsuits share a common set of complaints.
